Title IV of the Constitution contains the principles that inspire administrative action and guarantee the full submission of its activity to the Law and the Law, and configures the Government of the Nation as an eminently political body that directs the Administration and exercises regulatory power.
On the other hand, the Local Administration, whose legal regime is established as basic in the same article 149.1.18. of the Constitution, has a specific regulation in its current Law of Bases which offers no difficulty in adapting to the objectives of this Law and which does not require specific modifications.
The 1978 Constitution enlightens a new concept of Administration, subject to the Law and to the law, in accordance with the democratic expression of the popular will. The Constitution enshrines the instrumental nature of the Administration, placed at the service of the interests of the citizens and the political responsibility of the corresponding Government, insofar as it is responsible for directing it.

La Constitución recoge en su Título IV los principios que inspiran la actuación administrativa y garantizan el pleno sometimiento de su actividad a la Ley y al Derecho, y configura al Gobierno de la Nación como un órgano eminentemente político que dirige la Administración y ejerce la potestad reglamentaria.
En el ordenamiento originario del anterior régimen autocrático, el Gobierno quedaba reducido al Órgano Superior en el que culmina la Administración del Estado y, en consecuencia, concibiéndolo como un mero apéndice o extensión de la misma, con la que compartiría, en gran medida, su naturaleza administrativa. El artículo 97 de la Constitución arrumba definitivamente esta concepción y recupera para el Gobierno el ámbito político de la función de gobernar, inspirado en el principio de legitimidad democrática. Quedan así claramente perfilados los rasgos propios que definen al Gobierno y a la Administración como instituciones públicas constitucionalmente diferenciadas y los que establecen la subordinación de la Administración a la acción política del Gobierno.
